Kentucky Health and Safety Training, LLC Terms & Conditions for Community Courses

These Terms and Conditions below apply for all Community Courses, unless otherwise stated by the Administration of Kentucky Health and Safety Training, LLC.

By selecting “I agree”, you agree to the following terms and conditions:

Payment Terms & Conditions

You must make your payment ten calendar days prior to the start of the course. Acceptable methods of payment are: credit card. Credit card payments must be submitted online at www.kyhealthsafety.net. The following credit cards accepted are: Visa, Mastercard, Discover, or American Express. If you do not wish to pay by credit card, please notify Kentucky Health and Safety Training. If you do not make payment when due, your seat in any course may be released to other students. If course is cancelled you will receive a full refund of your payment, if already processed.

Failure to pay purchases in a timely manner, will cause this agreement to be placed in the hands of an attorney or collections agency. If this Agreement is placed in the hands of an attorney or a collection agency for collection following the occurrence of an Event of Default or any Breach hereunder, you agree to pay to Lender upon demand all costs and expenses, including but not limited to, all attorneys’ fees and costs incurred by KHST in connection with the enforcement of this Agreement (whether or not any action has been commenced by KHST) or in successfully defending any counterclaim or other legal proceeding brought by you.

Attendance, Cancellations Terms, and Conditions

If you need drop-out, please notify Kentucky Health and Safety Training or your Instructor. A message left at the providing facilities front desk will not be forwarded to a Kentucky Health and Safety Training representative.
Cancellation fees and refund amounts (if applicable) apply. Any student transferring course dates; will still pay cancellation/no-show fees. If not present for your course, you will not be eligible for a refund. If more than ten (10) minutes from the start time or more than five (5) minutes late from a break, you will be dismissed and not eligible for a refund. You must be present the entire time during the course. If you have an illness or major incident conflicting with your course, please contact Kentucky Health and Safety Training immediately. You will not receive a refund, but a (30) day window to re-register for the course (travel maybe required). Not all incidents or illnesses are acknowledged. Weather is permitting at all indoor and outdoor courses. You will be notified if there are any course modifications by email. Any course cancelled by Kentucky Health & Safety Training, will require the student to re-register. A representative of Kentucky Health and Safety Training reserves the right to dismiss you out of the class at his sole discretion, permanently, without a refund for any behavior that is violating regulations and that causes a danger to themselves or others. You will indemnify KHST for, and hold KHST harmless against, any damage to equipment, facility, or facility furnishings resulting from other than responsible behavior or actions other than as directly instructed by the Kentucky Health and Safety Training representative, including court-cost and legal fees (if necessary) and any and all other costs or damages.

Certifications will be issued at the provided email, upon successful completion of the course. If you have not received your certification within twenty (20) calendar days, please notify Kentucky Health and Safety Training immediately. Any course not successfully passed, will require remediation and to pay for the course again. Kentucky Health and Safety Training will not issue any certification until the entire course (including online components) have been proven by you to be successfully completed to the standards of the American Heart Association. Although few locations are subject to change and you must agree to travel up to an additional twenty (20) minutes from the course’s previous location before any refund is issued. These times are calculated by google maps and can be requested.

Governing law.

This Agreement shall be deemed to have been made under, and shall be governed by, the laws of the Commonwealth of Kentucky in all respects, including matters of construction, validity, and performance.

Jurisdiction. You hereby consents to the jurisdiction of any state or federal court located within the County of Warren, Commonwealth of Kentucky and irrevocably agrees that, subject to the KHST’s sole and absolute election, any case or proceeding relating to this Agreement as evidenced hereby shall be litigated in suchRevised November 11, 2017 courts, and you waive any objection which he or she or it may have based on improper venue or forum non conveniens to the conduct of any proceeding in any such court. Nothing contained in this paragraph shall affect the right of the KHST to bring any action or proceeding against you or his or he or its r property in the courts of any other jurisdiction.

Place of Execution. Regardless of where this Agreement is executed, it is deemed executed in Warren County, Kentucky, on the day and year written above. This agreement shall be interpreted in accordance with the laws of the Commonwealth of Kentucky.

WAIVER OF JURY TRIAL. KHST AND YOU ACKNOWLEDGE THAT THE TIME AND EXPENSE REQUIRED FOR TRIAL BY JURY EXCEED THE TIME AND EXPENSE REQUIRED FOR A BENCH TRIAL AND HEREBY KNOWINGLY, VOLUNTARILY, UNCONDITIONALLY AND IRREVOCABLY WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, AND AFTER HAVING CONSULTED OR HAVING HAD AMPLE OPPORTUNITY TO CONSULT THEIR RESPECTIVE LEGAL COUNSEL CONCERNING THE CONSEQUENCES OF SUCH WAIVER, TRIAL BY JURY IN ANY ACTION OR OTHER PROCEEDING (WHETHER BASED ON CONTRACT, TORT, OR OTHERWISE) BROUGHT TO IN CONNECTION WITH THIS AGREEMENT.
